Acceptance of Terms

These Terms constitute a legally binding agreement between you and InkFreakz. We reserve the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

Eligibility

To use InkFreakz, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the service under applicable law
• Provide accurate, current, and complete registration information
• Not have had a previous account terminated for violations of these Terms

By registering, you represent and warrant that you meet all eligibility requirements.

User Accounts

When you create an account, you agree to:

• Maintain the confidentiality of your login credentials
• Accept full responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access at security@inkfreakz.com
• Not share your account with any other person
• Not create multiple accounts to circumvent restrictions or bans

We reserve the right to reclaim usernames that violate trademarks or impersonate other individuals.

Content & Conduct

You May

• Post original tattoo work, designs, and professional content you own or have rights to
• Engage in professional communication with other users
• Use platform features for their intended purposes
• Promote your services in accordance with platform guidelines

You May Not

• Upload content that infringes on intellectual property rights
• Post offensive, abusive, harassing, or discriminatory content
• Engage in spam, phishing, or fraudulent activities
• Attempt to hack, scrape, or compromise platform security
• Create fake reviews, ratings, or manipulate contest votes
• Solicit clients to book outside the platform to avoid platform fees
• Impersonate any person or entity
• Post content involving minors in any inappropriate context
• Use automated bots or scripts to interact with the platform
• Circumvent any access controls or security measures

Platform Fees

InkFreakz charges a platform fee on transactions processed through the platform. Current fee structure:

Fees are deducted automatically at the time of transaction. We reserve the right to modify fee structures with 30 days' notice to affected users.

Guest Spot Bookings

The Guest Spots feature connects tattoo artists with shops for temporary residencies. The following terms apply to all guest spot arrangements:

For Artists

• You agree to honor confirmed guest spot bookings. Cancellations within 48 hours of the start date may result in forfeiture of the booking deposit
• You are responsible for maintaining professional conduct at the host shop
• You must comply with the host shop's house rules and local health/safety regulations
• Compensation terms agreed upon in the platform's invitation system are binding

For Shops

• You agree to provide the workspace and conditions described in your listing
• You are responsible for ensuring your shop complies with all local licensing requirements
• Cancellations of confirmed bookings without cause may result in negative impact on your shop's standing

Disputes

InkFreakz provides the platform for guest spot arrangements but is not a party to the agreement between artists and shops. We may, at our discretion, assist in mediating disputes but are not liable for outcomes of guest spot arrangements.

Appointments & Deposits

When clients book tattoo appointments through InkFreakz, a deposit is collected to secure the booking. The following terms apply:

• Deposits are non-refundable unless the artist cancels the appointment
• Clients who cancel within 48 hours of the appointment may forfeit their deposit at the artist's discretion
• Artists set their own deposit amounts within platform guidelines
• The platform fee (15%) is deducted from the deposit at the time of collection

InkFreakz is not responsible for the quality of tattoo services rendered. All disputes regarding tattoo services must be resolved directly between the client and the artist/shop.

Contests

InkFreakz hosts tattoo contests subject to the following rules:

• Only original work created by the submitting artist may be entered
• Vote manipulation (fake accounts, bots, coordinated voting rings) will result in disqualification and account suspension
• Contest organizers reserve the right to disqualify entries that violate community guidelines
• Prize distribution is the responsibility of the contest organizer, not InkFreakz
• By entering a contest, you grant InkFreakz a license to feature your submission in promotional materials
• Contest decisions are final and binding

Subscriptions & Paid Features

InkFreakz may offer premium subscription tiers or paid features. Where applicable:

• Subscriptions auto-renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds for subscription fees are not provided for partial billing periods
• We reserve the right to modify subscription pricing with 30 days' notice
• Downgrading or cancelling a subscription does not delete your account or content

Intellectual Property

Your Content

You retain full ownership of all content you upload to InkFreakz. By posting content, you grant InkFreakz a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the platform. This license ends when you delete your content or account.

Platform Content

All InkFreakz branding, logos, design elements, software, and platform features are owned by InkFreakz and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from platform content without express written permission.

Reporting Infringement

If you believe your intellectual property has been infringed, please review our DMCA Policy for instructions on submitting a takedown notice.

Indemnification

You agree to indemnify, defend, and hold harmless InkFreakz, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the platform
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you post or transmit through the platform
• Any guest spot arrangement or tattoo service you provide or receive

Disclaimer of Warranties

We are not responsible for the accuracy, completeness, or reliability of user-generated content, or for the quality of tattoo services arranged through the platform.

Limitation of Liability

To the fullest extent permitted by applicable law, InkFreakz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the platform.

In no event shall InkFreakz's total liability to you for all claims exceed the greater of (a) the amount you paid to InkFreakz in the 12 months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or your use of InkFreakz shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted by a mutually agreed-upon arbitrator under the rules of the American Arbitration Association (AAA). The arbitration will be conducted in English and may be conducted remotely.

Before initiating arbitration, you agree to first contact us at legal@inkfreakz.com and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the federal and state courts located in the United States.

Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any behavior we deem harmful to the platform or its users.

You may delete your account at any time through your account settings. Upon termination, your right to use the platform ceases immediately. Content you have posted may remain on the platform at our discretion, subject to our data retention policy.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and/or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms.
